Terms & Conditions: BIG Pharmacy – ‘#BalikKampungWithBIG’

The ‘#BalikKampungWithBIG’ is organized by BIG Pharmacy. By participating in this Contest, Eligible Participants (as defined in Clause 2.1 below) hereby expressly agree to be bound by these Terms and Conditions and any decisions made by BIG Pharmacy in respect of this Contest shall be final and binding.

1. CONTEST PERIOD

The Contest commences from 29th February 2024 at 12:00 AM MYT and expires on 31st March 2024 at 11:59 PM MYT, both dates inclusive, unless notified otherwise.

2. CONTEST MECHANICS & CONDITIONS

2.1         Participants must fulfill three conditions to be eligible for the contest:

• Register as a member with BIG Pharmacy (either through website, app, or any outlet).
• Obtain qualifying entries by making a purchase of at least RM50 in BIG Pharmacy.
• Submit a TikTok video with relevant theme, tags, and hashtags (refer Clause 2.5 – 2.9).

2.2         Qualifying entries includes any purchase made on both online & physical stores.

2.3         There is no limit to the number of entries available to be earned per day / per receipt.

2.4         The total number of entries will be recorded at the end of the contest, based on the total value of spending made during the event period.

2.5         The TikTok video must be made with the Hari Raya theme in mind. The content of the video will be up to the participants creativity.

2.6         Video contents that include contents relating to violence, politics, racism, and any other offensive elements shall be immediately disqualified.

2.7         The TikTok video must include the hashtag “#BalikKampungWithBIG”.

2.8         The TikTok video must have the tag “@bigpharmacymy”.

2.9         Eligible Participants must submit their video by providing a link to their video in a form prepared in the BIG Pharmacy app.

3. WINNER(S) SELECTION

3.1 Based on the Qualifying Entries earned, thirteen (13) Eligible Participants will be shortlisted by BIG Pharmacy’s randomizer program for the respective prizes. (The more entries earned, the higher the chance to be selected.)

3.2 Selection will be carried out after the end of the Contest Period.

3.3 Each Eligible Participants may only win one (1) Prize for this Contest.

3.4 Eligible Participants who have qualifying entries but did not submit any TikTok video (or vice versa) will be eliminated from selection.

4. PRIZE

4.1         At the time of awarding the Prize(s), the Membership account of the Eligible Participant must not be invalid or cancelled. Otherwise, such Eligible Participant shall be disqualified from receiving the Prize(s).

4.2         The announcement of the Winners (e.g. Name) may be made on BIG Pharmacy’s Facebook website and/or other social media platform within nine (9) working days from the end of the Contest Period.

4.3         Prize is subject to availability & BIG Pharmacy reserves the right to replace the prize with model of similar value.

4.4         BIG Pharmacy shall determine the methods of the Prize giving, including but not limited to, a Prize giving ceremony, or any other methods which BIG Pharmacy may deem reasonable.

4.5         BIG Pharmacy reserves the right at its discretion to allow or disallow the transfer of Prizes to another person/party even without any form of authorization from any of the Winners.

5. ADDITIONAL TERMS

By participating in the Contest, Eligible Participants/Winners:

5.1   Agree to be bound by the Terms and Conditions;

5.2   Agree that all records of transactions captured by BIG Pharmacy’s system within the Contest Period based on the local date and time shall be accurate, conclusive and final;

5.3   Agree that BIG Pharmacy’s decision on all matters relating to the Contest shall be final and binding on all Eligible Participants/ Winners. No further appeal or further correspondence will be entertained;

5.4   Agree that any reversal of spendings on qualified entries shall be excluded from the Contest; and

5.5  Consent for BIG Pharmacy to disclose their particulars to third party service provider(s)/ authorized supplier(s) including vendors, suppliers, advertising, and promotion agencies engaged by BIG Pharmacy for contact purposes during and after the Contest Period.

5.6   Authorize BIG Pharmacy to publish their names, photos taken, or other information provided by him/her for current & future advertising and publicity purposes in any advertising or publicity material relating to the Contest without any compensation;

5.7   Agree to access and to view the Terms and Conditions and are deemed to have agreed to it and with any changes or any of the Terms and Conditions be not fully understood; shall not be entitled to claim for and waive rights to any compensation against BIG Pharmacy nor any of its officers.

6. GENERAL TERMS AND CONDITIONS

6.1         BIG Pharmacy reserves the right to withdraw, cancel, suspend, extend or terminate this Contest earlier in whole or in part and reserves the right to modify any of the terms and conditions contained herein, from time to time by giving at least minimum of seven (7) days (“day” shall have the same meaning as calendar day) prior notice thereof, the notice of which shall be posted through BIG Pharmacy’s Facebook website or through any other channel determined appropriate by BIG Pharmacy. It shall be the responsibility of the Eligible Participants to be informed of or otherwise seek out any such notice validly posted.

6.2         By participating in this Contest, Eligible Participants agree to access the BIG Pharmacy’s Facebook website on a regular basis to view the terms and conditions herein and seek clarification from BIG Pharmacy should any of the Terms & Conditions be not fully understood.

6.3         By participating in this Contest, Eligible Participants agree to be bound by the Terms and Conditions herein and agree and consent to allow his/her personal data to be collected, processed, and used by BIG Pharmacy in the purposes of the Contest.

6.4         BIG Pharmacy and its officers, servants, employees, representatives and/or agents (including without limitation, any third party service providers engaged by BIG Pharmacy for the purposes of this Contest) shall not be liable to Eligible Participants in this Contest for any direct, indirect, special or consequential loss or damage (including but not limited to, loss of income, profits or goodwill) arising from or in connection with this Contest unless caused by any gross negligence or omission by BIG Pharmacy.

6.5         BIG Pharmacy shall not be liable for any default of its obligation under this Contest due to any force majeure events which include but not limited to acts of God, civil commotion, acts of war, strike, riot, lockout, industrial action, fire, flood, drought, storm, epidemic and pandemic or any events and circumstances of whatever nature beyond the reasonable control of BIG Pharmacy.

6.6         BIG Pharmacy may disqualify/reject any Eligible Participants who does not comply with the terms and conditions stated herein and/or are found or suspected to be tampering with the Contest and/or its process or the operations of this Contest which includes fraudulent activities involving any act of deceit and/or deception and/or cheating with regards to the Contest
